Terms of Service

1. Your agreement with Atrivial

These terms govern your use of Atrivial, including trivia games, the Portal, quiz creation, publishing, integrations, and paid subscriptions. Your agreement is with Atrivial, LLC. By accepting these terms or using the service, you agree to them. If you use Atrivial for an organization, you must have authority to act for that organization.

Our Privacy Policy explains how we process personal information. Participation in the affiliate program also requires agreement to the Affiliate terms.

2. Accounts and anonymous play

You can use supported trivia features without creating an account. Account features may require registration and accurate information. Protect your sign-in credentials and tell us if you suspect unauthorized access. You are responsible for activity you authorize through your account. Anonymous progress can depend on your browser and device storage.

Atrivial is not intended for children under 13, or under 16 in the European Union. You must have legal capacity to enter this agreement, or the permission of a parent or guardian where the law allows. Only someone authorized to make a purchase may start a paid subscription.

3. Acceptable use

Use Atrivial lawfully and respect other people's rights. You must not:

• Publish unlawful, infringing, deceptive, abusive, or harmful content.
• Impersonate others or send unsolicited communications through the service.
• Access another person's account, bypass access controls, or disrupt the service.
• Exploit security flaws, manipulate scores or payments, or use the service for fraud.
• Use integrations or automated access outside the permissions and limits we provide.

You are responsible for the audience, permissions, and legal requirements of the content and communications you publish through Atrivial.

4. Your content

You retain your rights in the source material, questions, branding, and other content you supply. You must have permission to submit that content and to ask us to process and publish it. You give Atrivial the limited permission needed to generate, host, display, deliver, support, and measure your quizzes according to your instructions and settings. This does not transfer ownership of your source material to us.

We do not add your source material or custom questions to the shared Atrivial Trivia Library or reuse them in other customers' quizzes. Our use of content, AI providers, and optional improvement settings is described in the Privacy Policy. People you share or publish a quiz with can access the content you make available to them.

5. Atrivial content and AI output

Atrivial and its licensors retain their rights in the service, software, branding, and Atrivial Trivia Library. Your plan permits you to use available Library content through Atrivial's quiz and publishing features. It does not give you ownership of the Library or an exclusive right to a question. Do not resell or redistribute the Library as a standalone collection without our permission.

AI-generated questions and answers can contain mistakes and may resemble other output. Review them before publication, including accuracy, source permissions, and suitability for your audience. We do not promise exclusive ownership or copyright protection for generated output.

6. Plans, payments, and free trials

The plan, price, billing interval, trial length, and applicable taxes shown before you confirm a purchase govern that subscription. Some free trials require a payment card. When you start a card-required trial, you authorize the subscription charge at the end of the trial unless you cancel before it ends. An annual plan charges the annual amount, even when a monthly equivalent is shown for comparison.

Paid subscriptions renew automatically at the disclosed billing interval until canceled. Payments are processed by Stripe. Keep your billing information current. We will notify you before a price change applies to a renewal and provide an opportunity to cancel. Plan limits and available features are described in the plan you choose.

7. Cancellation and refunds

You can cancel in the Portal's billing settings. Cancel before your trial ends to avoid the first subscription charge. For a paid subscription, cancellation normally takes effect at the end of the current paid billing period and prevents the next renewal. You can continue using the paid features until that period ends.

Canceling does not itself request or guarantee a refund. To request a refund or report a billing error, contact us. We review requests based on the circumstances and any rights required by applicable law. These terms do not limit mandatory cancellation, withdrawal, or refund rights.

8. Service changes and availability

We work to provide a reliable service, but maintenance, outages, provider failures, or other interruptions can affect access. We may update features and reasonable usage limits. If a change materially reduces a paid service during your billing period, we will give notice and explain the available remedy. Keep copies of source material and content that you need independently of Atrivial.

Third-party services and integrations have their own terms. Their availability and behavior may change, and you remain responsible for your accounts with those providers.

9. Suspension and ending access

We may restrict or end access when needed to address a breach of these terms, unlawful activity, a security risk, or a legal requirement. We will give notice and an opportunity to resolve the issue when reasonably possible. Urgent security or legal concerns may require immediate action. You can stop using the service and request account deletion through Contact Us.

Cancel your subscription before deleting your account. Ending access does not remove payment obligations already incurred or rights and obligations that must continue, including content rights, valid refund claims, and responsibility for earlier conduct.

10. Responsibility and legal rights

We will provide the service with reasonable care. We cannot guarantee that it will always be uninterrupted, free of errors, or suitable for every purpose. You are responsible for your content and use of the service. Each party's responsibility for losses is determined by applicable law. Nothing in these terms excludes or limits liability where doing so would be unlawful, or removes consumer rights that cannot be waived.

11. Changes to these terms

We may update these terms as the service or legal requirements change. We will publish the updated version with its effective date and give notice of material changes by email or a prominent notice in Atrivial. Changes apply prospectively. If a material change requires renewed acceptance, we will ask you to accept it before it governs your further use. You can stop using the service and cancel a subscription if you do not agree.
